Open Container

It is not a smart decision to drink alcohol in a moving vehicle or drink alcohol on the streets of Myrtle Beach. South Carolina law prohibits having an open container of beer, wine or liquor in a moving vehicle of any kind except in the trunk or luggage compartment.

South Carolina law also prohibits drinking alcoholic liquors in public conveyances. There are exceptions for drinking alcoholic liquors in public and these can be found in the South Carolina Code of Laws Section 61-6-4710. A person who violates the open container laws in South Carolina may be found guilty of a misdemeanor and may face fines and even imprisonment.

There are always exceptions to the rule, which means you may have a valid excuse under the law that will allow you to escape punishment. If you feel law enforcement has unfairly targeted you and has cited you for any crime you have not committed, contact your local attorneys at Axelrod & Associates, P.A.
